1. Acceptance of Terms
By accessing or using the Site in any way — including browsing pages, using the Savings Calculator, or submitting a form — you agree to these Terms. If you do not agree, do not use the Site.
PartnerMCP may update these Terms from time to time, as described in Section 8. Continued use of the Site after an update constitutes acceptance of the revised Terms.
2. Description of the Website and Services
The Site is an informational and marketing resource. It describes PartnerMCP's approach to enterprise implementation, integration, automation, and software-cost optimization, and provides tools such as:
- A Savings Calculator that produces illustrative, non-binding estimates based on inputs you provide.
- A Dashboard Preview that demonstrates how reporting and analytics may appear in a live engagement.
- Resources, product overviews, and pricing information intended to help evaluate whether PartnerMCP is a fit for your organization.
The Site does not itself deliver implementation, integration, or automation services. It is a starting point for evaluating PartnerMCP, not the delivery mechanism for any engagement.
3. This Is Not a Services Agreement
Nothing on the Site — including estimates generated by the Savings Calculator or figures shown in the Dashboard Preview — constitutes an offer, quote, or binding commitment by PartnerMCP to perform any services.
Any actual implementation, integration, automation, or software-cost optimization engagement is governed exclusively by a separate, mutually signed agreement (which may include a master services agreement, statement of work, or order form) executed directly between PartnerMCP and the customer. If these Terms conflict with a signed services agreement, the signed services agreement controls.
4. Acceptable Use
When using the Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of applicable law or regulation.
- Attempt to gain unauthorized access to the Site, its underlying systems, or any connected infrastructure.
- Interfere with or disrupt the Site's operation, including through excessive automated requests, scraping, or denial-of-service activity.
- Submit false, misleading, or fraudulent information through any form, including the Savings Calculator or contact forms.
- Reverse engineer, decompile, or attempt to extract source code from the Site except as permitted by applicable law.
PartnerMCP reserves the right to restrict or terminate access to the Site for any user who violates these Terms.
5. Intellectual Property
The Site, including its text, design, graphics, logos, product names, and underlying code, is owned by PartnerMCP or its licensors and is protected by applicable intellectual property laws.
You may view and use the Site for your own evaluation of PartnerMCP's services. You may not copy, modify, distribute, publicly display, or create derivative works from the Site's content for commercial purposes without PartnerMCP's prior written consent.
PartnerMCP and associated marks used on the Site are the property of PartnerMCP. No license to use these marks is granted except as expressly stated in these Terms.
6. Disclaimers; Savings Calculator
The Site and all tools on it, including the Savings Calculator and Dashboard Preview, are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.
The Savings Calculator produces illustrative estimates only, based on the inputs you provide and general assumptions about license usage, contract structure, and implementation cost. It is not an audit, a quote, or a guarantee of any outcome. Actual results depend on your organization's systems, contracts, data quality, and the scope of any engagement, and may vary — potentially significantly — from any estimate shown. PartnerMCP does not guarantee any specific level of cost savings, efficiency gain, or return on investment unless expressly set out in a signed services agreement.
The Dashboard Preview is a representative demonstration and does not reflect the specific data, metrics, or configuration of any actual customer engagement.
7. Limitation of Liability
To the maximum extent permitted by applicable law, PartnerMCP and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of, or inability to use, the Site — including any reliance on estimates produced by the Savings Calculator or figures shown in the Dashboard Preview.
To the extent liability cannot be excluded under applicable law, PartnerMCP's total liability arising out of or related to your use of the Site will not exceed the amount, if any, you paid to PartnerMCP for use of the Site itself.
8. Governing Law; Changes to These Terms
These Terms are governed by the laws of [Governing State/Country — to be finalized], without regard to its conflict-of-laws principles.
